| Performance Metrics: LexisNexis will provide access to legal research, public records, news, and investigative databases, and other tools as described in this Agreement. |
| Financial Consequences: LexisNexis shall provide a prorated credit or refund as determined by the JAC, as financial consequences, for contractor system failures which result in the interruption of JAC access to the contracted online databases for any period of time exceeding twenty-four (24) hours in duration. Due to the time sensitive nature of the legal research, overall the LexisNexis online database services system must be available a minimum of 95% of the total time represented in each billing period. LexisNexis shall provide a summary of system outages during the billing period and the duration of each outage. If overall outages exceed 5% of any monthly contracted period, then the total invoice for that month will be reduced 5%. |
