Major Deliverable: B. Construction Activation No. 1 Hazardous Materials Survey as part of CM at Risk Preconstruction Services at Silver Springs State Park Conference Facility Renovations. Monthly invoices shall be rendered in accordance with the approved Schedule of Values.

Non Price Justification:

Performance Metrics: The Contractor shall perform the Work within the Contract Term and for the Contract Price set out in the Contract of which this Agreement is a part. The Contractor shall perform the Work to the satisfaction of the Department. The Contractor shall supply all labor, equipment, and materials necessary to perform the Work unless otherwise specified in the Contract Documents. The Contractor shall perform the Work in accordance with the Contract Documents for which the Contractor shall be paid the Contract Price set out in Section 7 of this Agreement in the manner provided in Article 7, General Conditions.

Financial Consequences: No payment will be made for unsatisfactory deliverables. In the event that a deliverable is deemed unsatisfactory, the Consultant shall re-perform the services needed for submittal of a satisfactory deliverable, at no additional cost to the Department within 15 consecutive days. If a satisfactory deliverable is not submitted within the specified timeframe, the Department may, in its sole discretion, terminate the Contract for failure to perform.
