Major Deliverable: Provide standard commercially available laboratory gases that meet the specifications as described in ITB 2018026, (“Solicitation”) and Contractor’s response thereto, incorporated herein by reference, listed in the Scope of Work on an as-needed basis in accordance with Attachment A , Scope of Work (“Scope”) and all exhibits and Attachments named and incorporated herein by reference. Contract price not to exceed 122,000. A1: Extension. A3: Revised Rate Schedule. A4: Revised Rate Schedule.

Non Price Justification: Rate Agreement

Performance Metrics: Review and approval as-needed of sales and services of compressed specialty gases and cryogenic liquids as outlined in Attachment A of contract by the DEP Contract Manager.

Financial Consequences: No payment will be made for deliverables deemed unsatisfactory by the Department. If a good is rejected as nonconforming, Contractor shall provide a replacement good that meets the requirements of the technical specifications to Department at no cost. In the event that a service deliverable is deemed unsatisfactory by the Department, the Contractor shall re-perform the services needed for submittal of a satisfactory deliverable, at no additional cost to Department, within a reasonable time of being notified of the unsatisfactory deliverable.
