Contract’s Exemption Justification: DFS is directed by statute to update the Fire Prevention Code by rule on a triennial basis, and to adopt the currrent editions of National Fire Protection Association (NFPA1 and NFPA 101), at a minimum. NFPA holds a copyright on the standards adopted in the rules. Bni Publications, Inc. is the publishing arm of NFPA, and the only authroized publisher of the NFPA standards.
