Fixed Fee / Unit Rate

Major Deliverable: Provide refrigerated milk and dairy products listed in the contract upon the order of the FSDB Food Services Department. Prices to be determined monthly in accordance with a formula the basis of which is the Federal milk marketing order prices supplied by the USDA, Agriculture Marketing Service, Dairy Programs, announcement of Class I prices for milk and butterfat differential. Prices shall include shipping and delivery.

Non Price Justification: Price cannot be determined until the work has been completed

Performance Metrics: Products shall: 1. Be in prime condition at time of delivery, 2. Be delivered in refrigerated trucks, 3. Be chilled to a temperature no higher than 40 degrees F, 4. Have the code date for milk that shows a minimum of seven (7) days useful life remaining on day of delivery, 5. Not be delivered frozen. 6. Conform to the USDA's "Buy American" provision which means that the product must be processed in the US using domestic agricultural commodities and contain a minimum of 51% US produced product. 7. Not be delivered in damaged, leaking or crushed packaging.

Financial Consequences: Failure to deliver products as ordered shall result in non-payment for the products delivered and return of unacceptable products.
